Confidential Settlement – Sexual Assault of Teenager by Restaurant Manager

Most parents encourage their teenagers to develop responsibilities and get a job to earn some money. One of those families hired John Leighton after his 14-year-old son was sexually assaulted. The boy worked in a pizzeria. As part of his job, he was taken to apartment complexes to hang promotional coupons on the apartment doors.

One day after work, the restaurant manager took the boy to his apartment and sexually assaulted him. Mr. Leighton demonstrated through litigation that the restaurant did not conduct an adequate background check on the manager. A reasonable investigation would have shown that he had been in prison for a prior sexual offense in another state. Mr. Leighton obtained a confidential settlement for this young man.

This is an example of negligent hiring, negligent retention, and negligent supervision.
