$1,136,000 settlement – premises liability – sexual assault at shopping center

John Elliott Leighton was retained by a Wisconsin woman who was sexually assaulted in a factory outlet mall.  While she was working alone in a store, the serial rapist came in, locked the door, tied her up and assaulted her.  He took her drivers license so he could know where she lived.  She developed a severe post traumatic stress disorder which paralyzed her.  She was unable to function effectively in society for a long time.  Her assault and experience with this criminal forever changed who she was.

Mr. Leighton discovered through litigation many instances of crimes and warnings to the management company, as well as cutbacks in security which resulted in this crime.  After litigation in Kenosha, Wisconsin, the case was settled for $1,136,000 prior to trial. The perpetrator was tied to several sexual assaults and rapes at factory outlet malls around the country. L.F. v. McArthur Glen.
