$3,000,000 settlement – premises liability – ATM security – shooting (Indiana)

John Elliott Leighton was called upon to litigated this inadequate security case in Indianapolis, Indiana on behalf of a 25 year-old man left paralyzed when he was shot at an ATM.  The man was using the ATM in the evening and was approached by a robber, who forced him to withdraw money at gunpoint and then attempted to abduct him in a nearby car.  When the man did not enter the car, he was shot.  The gunshot caused a permanent spinal cord injury in this previously athletic, healthy young man.Through litigation, Leighton demonstrated that the financial institution ignored hazards to its customers and had considered but rejected suggestions to install a drive-through ATM for use at night.  Mr. Leighton obtained a $3,000,000 confidential settlement prior to trial, affording our client financial security for the rest of his life.
