    $600,000 settlement – man falls at construction site while working in building (Miami)

    Construction sites are dangerous places.  Hazards at construction sites in Florida often involve falls or being struck by falling materials or tools.

    Mr. Leighton represented the family of a man who fell from the second floor of a partially completed building. The opening was intended to be a staircase and there was an open hole there at the time of the fall.  He was working at a job site which involved renovations to the inside of a warehouse.  There were no railings and he fell to his death. Decedent had contracted with the owner to perform renovations inside the warehouse without permits. Defendant claimed that the decedent was responsible for placing safety equipment or barricades.  John Leighton obtained a $600,000 settlement on behalf of his surviving wife and children prior to trial. Vergara v. Espar, et al., Miami Dade Circuit Court.
