$250,000 settlement after trial – construction worker sustains wrist injury in fall (North Carolina)

John Elliott Leighton was retained to represent a construction worker who fell from a 3rd floor construction site without railings.  Mr. Leighton tried the case in Mecklenberg County, Charlotte, NC, which has pure contributory negligence.  The evidence revealed that the construction worker had known of the lack of railings but had proceeded to work in the area.  Following a hung jury, the case settled for $250,000.
