    $1,050,000 Settlement – Death of Disabled Child in Emergency Room

    Every child deserves quality medical care.  This is particularly true for children with disabilities and medical conditions.

    Our client had a medical condition that required he breath through a tracheostomy — a tube in his throat.  While his mother was cleaning his tube, a piece of cotton swab became stuck in the tube.  EMS personnel came but could not retrieve it.  The boy was never in distress and was still able to breath.  But the paramedics decided to transport him to a hospital so a pediatric pulmonologist could retrieve the swab.

    While at the hospital, a pediatric pulmonologist treated the boy. The boy underwent a bronchoscopy which was performed improperly, and hospital staff failed to recognize that he developed a pneumothorax, resulting in his death.

    John Elliott Leighton obtained a confidential settlement on behalf of parents whose disabled son was killed through a medical mistake in an emergency room.   Mr. Leighton obtained a settlement with the physician and hospital for $1,050,000 prior to trial.
