    Aviation & Airplane Accident Lawyers

Commercial Aircraft – General Aviation (private planes) – Helicopters accidents

Though considered the safest mode of transportation, airplanes do crash. When they do, it is often the result of several failures – human and/or mechanical. Leighton Panoff Law aggressively litigates airplane crash cases, including commercial aviation, general aviation (small planes) and helicopters.

The firm also handles cases involving injuries caused by airline and airport personnel in landside operations. Aviation accidents require specialized investigative skills and intensive investigation. We work with a team of aviation accident investigators and engineers to investigate crash sites and recreate accidents to identify the causes of aviation disasters.

Leighton Panoff Law is considered a top airplane accident lawyers in the Miami and Orlando area.

Below are some of the most common reasons for aviation accidents

Most likely when an airplane crashes, either commercial or personal, it is because of a human error or a mechanical issue or even a combination of the two. Some of the most common reasons are outline below, but there could be many other factors that cause plains to crash

    • A pilot who is too tired to fly, stressed, or under the influence of alcohol or drugs.
    • Running out of fuel can most likely lead to an airplane accident.
    • Mechanical issues or misuse of the technology.
    • Flying in dangerous weather conditions.
    • Not fully completing the pre-flight checks and inspections.
    • Take off or landing issues or errors.
    • Air traffic control mistakes.
    • Flying too low.

Managing partner John Elliott Leighton has been instrumental in obtaining recoveries for victims of plane crashes and aviation disasters, including general aviation (crash of small plane in bad weather where tower had instructed inexperienced pilot to turn in direction of weather system, resulting in $2.8 million settlement), ground victims ($500,000 settlement for victim of smoke inhalation after residential plane crash), and commercial aviation (settlements of $430,000 and $300,000 against major airlines).

We understand that if you have lost a loved one in a plane or helicopter crash, it is devastating and sudden.  There was no closure. It feels unreal, and often made worse by an inability to see your loved one or say goodbye.

Our approach to aircraft disasters and aviation injuries is unique to each case and each client. Leighton Panoff Law does not subscribe to a “one size fits all” approach to our clients. Instead, each client’s needs are individually assessed.

If there is a need to coordinate medical, psychological and vocational care, we provide that in addition to litigating and trying cases. Because many aviation disasters are so devastating to families, we are always conscious of the need to serve people individually.

Mechanical issues that cause aviation accidents

Aviation accidents caused by mechanical errors are one of the most common reasons for aviation disasters. In some cases, flaws in the design may cause planes to behave dangerously in the sky or ware down over time. Even if the manufacturing was done perfectly, because of the design issue, the plane can be dangerous to fly.

In some cases the design process was perfect by a manufacturing issue caused a plane to crash. This can be a case of ” simple ” parts being incorrectly assembled or produced.

If you were hurt in an airplane or helicopter accident because of a faulty design or manufacturing, you may have a product liability claim, either against  the manufacture or even the designer.

    Negligent maintenance

Another common reason for aircraft accidents is poor maintenance or negligent maintenance. When the owner of the aircraft doesn’t properly conduct inspection of the plane or does not follow with the strict maintenance schedule, the aircraft can become a dangerous place to be around.

Pilots must inspect their planes and conduct detailed maintenance to make sure their aircraft is up to code, if they fail to do so, or worse, simply ignore the rules, can lead to crashes and serious injuries.

If a commercial airline fails to conduct the necessary inspections and maintenance work needed to make sure they aircraft are working properly, and a plane crashes, they are responsible for the damages caused both in physical injuries and in financial loss.

    National Transportation Board Investigations

airplane accident lawyersAnytime a plane crashes in the United States the National Transportation Safety Board ( NTSB ) will make an official investigation to find out what happened that caused the crash.

It may also investigate crashes that happened outside the US if the plane was registered in the US. On average, the NTSB investigates around 2,000 events each year, and makes a detailed report, which can be very useful in personal injury cases.
