$4,300,000 settlement – delay in treatment (Chicago)

Cheryl Wiedenbeck was a book editor and mother of her two young daughters, ages 2 and 8 months. She developed an excruciating headache that was later diagnosed as a benign cyst (colloid cyst of the 3rd ventricle) in her brain. The cyst blocked the flow of cerebrospinal fluid, and caused an increase in pressure in her skull. She went to her local hospital who later transferred her to the University of Chicago Medical Center. There she was left in the hands of a new resident who failed to recognize the urgency of the situation.

The resident decided to wait until the next day for the attending surgeon to treat the patient. They failed to place an intracranial pressure monitor.

While waiting for care, Cheryl’s brain herniated, leaving her brain damaged. Her husband and two daughters cared for her as if she were another child for four years, until she unexpectedly died.

John Elliott Leighton was retained by this Illinois family to litigate their medical malpractice case in Cook County, Illinois. During litigation, a settlement of $4,300,000 was obtained on behalf of Cheryl’s children and surviving husband. Estate of Wiedenbeck v. University of Chicago Hospital (Cook County Circuit Court, Chicago, IL).
