$750,000 settlement – premises liability – shooting at convenience store

John Elliott Leighton obtained a$750,000 settlement on behalf of a convenience store clerk who was shot during an armed robbery. The man was shot in the face.  Leighton developed evidence that the property failed to comply with minimum lighting standards and argued that it was a case of negligent security and lighting. The incident occurred in North Miami, Florida.

The case involved a 24 hour convenience store which was in a high crime area.  Mr. Leighton assembled a team of investigators and experts who determined that the crime was foreseeable and that the property owner failed to take reasonable security measures, including minimum lighting.  Under the Miami-Dade Code, there are minimum requirements for lighting and illumination at commercial premises. Why is this important? Because crime thrive sin darkness.  Criminals want to enter and exit without being discovered or apprehended.  The less light…the more crime.
