$1,007,000 Verdict – Falling merchandise resulting in fracture (Miami-Dade County)

Big box stores are popular because of the merchandise they have available for purchase, the quantities they carry, and their prices. But stores have a responsibility to the shopping public to keep their stores safe for customers. This is particularly true for “warehouse” stores, which keep their stock on the sales floor.

John Elliott Leightonwas hired to represent a woman who was shopping at a big box store (Costco). She was shopping for paper goods in the hallway with her husband. When she attempted to grab a package of toilet paper from the shelf, the entire box of toilet paper fell on top of her, knocking her off of her and causing a serious fracture to her leg. The fracture was so severe that she required surgeries and an external fixator that protruded through her skin. A business owner, her injuries interfered with her work and lifestyle. She was unable to carry out the lifestyle and activities she did every day before her injury. Costco denied all liability and the case went to trial. Mr. Leighton tried the case in Miami-Dade County Circuit Court and obtained a verdict for our client of $1,007,000. Godur v. Costco, 2001 WL 1783031 (Miami-Dade County Circuit Court).
