$550,000 settlement – sexual abuse in hospital by physician

Hospitals are supposed to be safe places, dedicated to healing and recovery.

Our client was a young woman who was admitted to a Miami hospital for treatment following a serious car accident.

During the time she was there recovering from her injuries in the car crash, a resident physician came to her room.  On two occasions he entered the room and sexually fondled her genitals.  There was no reason for him to have even entered her room.  Our client reported the conduct to the hospital.  The doctor denied that the incident happened.  Leighton Panoff Law’s Max Panoff and John Leighton were able to prove that this physician did in fact enter her room without any justifications at the times she reported.

The case was settled confidentially for $550,000 plus the hospital’s firing of the doctor and reporting him to the Board of Medicine.  This was required so that he would not be able to do this to another patient again.  Our years of litigating sexual abuse cases has shown us that abusers keep repeating their crimes until they are permanently stopped.  This is a case where our client’s efforts to bring a serial sexual abuser to justice resulted in his being stopped in his tracks.
