$1,136,000 settlement – premises liability – sexual assault at a shopping center

John Elliott Leighton was hired by a Wisconsin woman who was sexually assaulted at a shopping center. While she was working alone in a store, the serial rapist entered, closed the door, tied her up, and assaulted her. She took away his driver’s license so she could find out where she lived. She developed severe post-traumatic stress disorder that paralyzed her. For a long time she was unable to function effectively in society. Her assault and her experience with this criminal forever changed who she was.

Mr. Leighton discovered through litigation many instances of crimes and warnings to the management company, as well as cuts in security that resulted in this crime. After litigation in Kenosha, Wisconsin, the case settled for $1,136,000 before trial. The perpetrator was linked to several sexual assaults and rapes in shopping centers across the country. L.F. v. McArthur Glen.
