What to Do If You’re Seriously Injured as a Passenger in an Uber/Lyft

Over the past decade, Uber and Lyft have skyrocketed in popularity as alternatives to taxis, offering competitive rates and the convenience of ordering a ride on-demand through an app. However, despite their many benefits, there are certain hazards that could potentially place rideshares at a higher risk of being involved in an accident. For instance, many people drive for Uber or Lyft as a second or even third job, making them more likely to be fatigued while on the road; in addition, drivers are often distracted by notifications from the app or their GPS systems.

As a passenger in an Uber or Lyft, you trust that your driver will safely transport you to your destination—but in the event that you are involved in an accident that results in serious injury, there are several important steps to take, including the following:

    • If you are able, call 911 immediately. Contacting the authorities is important not only for getting emergency medical help, but also for ensuring that a police report is filed. As you navigate the process of dealing with insurance companies or possibly pursuing a lawsuit, a police report may be instrumental to your case.
    • Gather and document any information you can about the accident. For example, ask for the driver’s name, license plate number, and insurance information. Make note of where and when the accident occurred, and if possible, talk to witnesses and other parties involved. Additionally, take photos of vehicle damage and any visible injuries you may have.
    • Seek medical care as soon as possible. Even if you don’t appear to be seriously injured at first, it’s best to be examined by a doctor, as some conditions may not appear initially. Be sure to keep copies of medical records and bills from any providers you visit, and document your symptoms and when they appear.
    • Notify the ridesharing company. In addition to requiring their drivers to carry personal car insurance, Uber and Lyft have additional insurance that may provide compensation of up to $1 million per passenger involved in an accident. However, the exact amount of your settlement will depend on several different factors.
    • Contact an attorney. Any time you are involved in a car accident, working with an experienced attorney is the key to maximizing any compensation to which you may be entitled—but when the accident takes place in an Uber or Lyft, the stakes are even higher.
